January 24, 2006 -- Fruit, nut and vegetable operations that recieve, hold and ship raw agricultural commodities, like sweet corn, green beans, carrots, alfalfa sprouts, peppers, apples and other crops, are mandated by the Bioterrorism Act of 2002 to register all of their facilities, and maintain detail records wherever food commodities and produce are received, cleaned, stored, blended and processed and then shipped again.

Operations that receive raw agricultural commodities and manufacture them into food and pack it also are required to comply with this law. Delivery truck drivers and the trucks must be recorded as well. Keeping detailed records of all produce received, stored and shipped is required to help prevent natural or terrorist contamination.

The recordkeeping process for Nuts, Fruits and Vegetables must be in place by June 2006 for operations that have eleven or more employees. After the noted date, all records must be avalable to the FDA as soon as possible, and no longer than 24-hours after a request is made if contamination is tracked to a produce handling operation.

The records requested by FDA may be related to the manufacture, processing, packing, transporting, distribution, receipt, holding, or importation of such an article of food that are maintained by, or on behalf of, an entity subject to the recordkeeping regulation, and at any location.
